1. INTRODUCTION:
Welcome to Coach2o, a professional coaching service operated by AWH Advising LLC, a Delaware Limited Liability Company. These Terms and Conditions outline the rules and regulations for the use of our services, which are accessible through our website and via direct engagement. By using our services, you consent to be legally bound by these Terms and Conditions and our Privacy Policy.
2. SERVICES:
Coach2o offers specialized coaching services tailored for individual and organizations focused on personal and professional development. Our flexible coaching packages enable clients to select the ideal coach and customize the frequency and duration of sessions to suit their specific needs.
INDIVIDUAL COACHING: We provide one on one coaching targeting personal growth, goal attainment, and skills enhancement. Each session is a deep dive into a topic crucial to the clients personal or professional growth. Our expert coaches guide clients through focused discussions to uncover insights and develop practical strategies, helping them move confidently toward their desired outcomes.
ORGANIZATIONAL COACHING: Our programs are designed to enhance leadership capabilities, improve team dynamics, and boost organizational efficiency. We work closely with businesses to create coaching solutions that align with their strategic objectives and cultural values.
GROUP COACHING AND NETWORKING: Coach2o also offers group coaching sessions and hosts weekly networking events designed to foster community engagement, socialization, and professional connections. These gatherings range from informal virtual meetups to structured seminars with industry experts, enhancing learning and networking opportunities for participants.
Clients are expected to engage actively and respectfully in all services, adhering to Coach2o’s established norms and guidelines to maintain a productive and positive environment.
3. ELIGIBILITY:
To access and utilize the services provided by Coach2o, the following eligibility criteria must be met:
AGE REQUIREMENT: Individuals must be at least 18 years of age. Alternatively, individuals under the age of 18 are eligible to participate if they are sponsored by a legal guardian or an accredited educational institution. Such sponsorship must include consent to these Terms and Conditions on behalf of the minor, acknowledging agreement to abide by the rules and guidelines set forth by Coach2o.
COMPLIANCE WITH TERMS: All users, regardless of age, must agree to comply with these Terms and Conditions as a prerequisite for using our services. This compliance ensures that all participants understand and adhere to our operational guidelines and ethical standards, which are designed to maintain a professional and safe environment for everyone involved.
LEGAL CAPACITY: By agreeing to these Terms and Conditions, users affirm that they have the legal capacity to enter into a binding agreement. In the case of minors, the sponsoring guardian or educational institution assumes this responsibility by providing consent.
All clients are expected to maintain a high standard of integrity and respect throughout their engagement with Coach2o services. Failure to meet these eligibility requirements may result in the restriction or termination of service access.
4. FEES AND PAYMENT:
Coach2o offers a transparent fee structure for its coaching services, which are payable in advance to ensure seamless provision of services.
PAYMENT METHODS:
INDIVIDUAL CLIENTS: We accept debit cards and all major credit cards, ensuring a convenient and secure transaction process for our individual clients.
ORGANIZATIONAL CLIENTS: We accept payment via credit card, bank transfers, or certified checks. A fee of 2.5% will be added to payments made with a credit card. This allows for greater flexibility and security in handling larger transaction volumes typical of organizational contracts.
PAYMENT TIMING: All payments must be made before services are provided. This pre-payment policy helps in managing schedules and resources efficiently, ensuring that clients receive uninterrupted and timely access to coaching services.
CREDITS AND REFUNDS:
CREDITS: In instances where a client cannot attend a pre-paid coaching session and notifies us within the agreed cancellation period, a credit will be issued to their account. This credit can be applied towards future coaching sessions.
CREDIT EXPIRY: Credits issued must be used within one year from the date they are applied to a client’s account. After this period, unused credits will expire and cannot be refunded or transferred.
NO REFUNDS: Coach2o maintains a no-refund policy. Once paid, fees are non-refundable except in the form of credits as specified above.
5. CANCELLATIONS AND RESCHEDULING:
Coach2o understands that schedules can change, and flexibility is essential for our clients. To accommodate these changes, we offer a straightforward process for canceling or rescheduling coaching sessions.
HOW TO CANCEL OR RESCHEDULE:
CLIENT PORTAL: Clients are encouraged to use the client portal for the quickest and most efficient way to cancel or reschedule a session. The portal is accessible 24/7 and provides immediate confirmation of changes made to your bookings.
CUSTOMER SUPPORT: For those who prefer or need assistance, cancellations and rescheduling can also be handled by contacting our customer support team. Our team is available to help during regular business hours and can be reached via email or phone. Contact details are provided on our website and through client communications.
NOTICE PERIOD:Clients are required to notify us of any cancellations or rescheduling at least 24 hours in advance of the scheduled session time. This allows us to manage our resources effectively and offer the slot to other clients.
HANDLING TARDINESS:
MINOR DELAYS: If you are more than 5 minutes late for a session, your coach will attempt to contact you via email, phone, or text message to determine if you are able to join the session promptly.
SIGNIFICANT DELAYS: If you are more than 15 minutes late, the session will be marked as a "No Show."
REPEATED NO SHOWS: Accumulating three "No Show" incidents in a given period, whether from significant delays or failure to attend without any prior notification, may result in Coach2o exercising the right to terminate your services. This policy helps maintain the integrity of scheduling and respects the time of our coaches and other clients.
CREDITS FOR CANCELLATIONS:
If a session is canceled within the required notice period, a credit for the value of the session will be applied to your account. This credit can be used towards future sessions and is valid for one year from the date of issue.
LATE CANCELLATIONS AND NO SHOWS:
Sessions canceled with less than 24 hours' notice will be charged in full, and no credits will be issued. Similarly, "No Show" incidents will result in the full session fee being charged. We encourage clients to communicate any changes as early as possible to avoid unnecessary charges.
6. SESSION DELIVERY:
Coach2o offers versatile delivery methods for our coaching sessions to accommodate the diverse needs and preferences of our clients.
VIRTUAL SESSIONS: The default mode of delivery for our coaching sessions is via virtual platforms. We utilize approved video conferencing applications such as Zoom and Google Meet, which allow for flexible and accessible coaching experiences. Clients will receive a link to join the session through the chosen platform prior to their scheduled appointment.
PHONE SESSIONS: For clients who prefer or require telephone-based sessions due to connectivity issues or personal preference, coaching sessions can be conducted over the phone. Clients should specify this preference at the time of booking to ensure smooth session delivery.
IN-PERSON SESSIONS:
INDIVIDUAL CLIENTS: In-person sessions are available upon request and are subject to the mutual agreement of both the client and the coach. Such arrangements depend on the availability of the coach and the feasibility of meeting in a suitable location that adheres to any prevailing public health guidelines.
ORGANIZATIONAL CLIENTS: For organizations, in-person meetings, workshops, and facilitated discussions are offered as part of our extended services. These sessions incur additional expenses related to the coach's time, travel, accommodations, and venue (if not provided by the organization).
PRICING AND APPROVAL: All requests for in-person sessions with organizations must be specifically priced and approved in advance by Coach2o’s executive leadership team. This ensures that all associated costs are transparently communicated and agreed upon before the commitment of resources.
ADHERENCE TO SAFETY PROTOCOLS: For all in-person interactions, Coach2o is committed to adhering to the latest safety protocols to ensure the health and well-being of both our clients and staff. Clients and coaches are expected to comply with these guidelines during their meetings.
7. RECORDING OF SESSIONS
CONSENT FOR RECORDING:
INDIVIDUAL AND ORGANIZATIONAL SESSIONS: Recordings of coaching sessions are not made without explicit consent from both the coach and the client. Prior to recording any session, explicit approval is sought from the client, ensuring transparency and respect for privacy. If consent is not granted, the session will proceed unrecorded.
STORAGE AND ACCESS:All approved recordings are securely saved to a shared drive, accessible only to the coach and the client involved in the session. This practice ensures that both parties can review the session as needed to support the client's development goals.
CONFIDENTIALITY AND THIRD-PARTY SHARING:Coach2o maintains a strict confidentiality policy regarding the handling of session recordings. Individual session recordings are not shared with third parties, nor are they used outside the context of the client-coach relationship without additional consent.
RECORDINGS OF PUBLIC EVENTS:
NETWORKING EVENTS, SOCIAL GATHERINGS, AND GROUP COACHING: Recordings of events facilitated by Coach2o, such as networking events, social gatherings, and group coaching sessions, may be used for advertising and promotional purposes. Participants in these events will be informed beforehand that the event may be recorded and potentially used in Coach2o’s promotional materials. This ensures all participants are aware of the use of their images and contributions and can opt-out if they prefer not to be recorded. By participating in any coaching session or event with Coach2o, clients agree to the terms of this recording policy, ensuring a clear understanding of how recordings are managed and utilized to protect the interests and privacy of all parties involved.
8. INTELLECTUAL PROPERTY
Coach2o takes the protection and respect of intellectual property seriously, recognizing it as a vital element of the coaching relationship.
OWNERSHIP OF MATERIALS:
COACHING MATERIALS: All coaching materials provided by Coach2o, including but not limited to worksheets, exercises, presentations, articles, and proprietary methodologies, are the intellectual property of Coach2o and AWH Advissing LLC. These materials are provided to clients for their personal development and are not to be reproduced, distributed, or used for any other purpose without explicit written consent from Coach2o.
CLIENT-GENERATED CONTENT: Any content, including plans, notes, and business strategies developed by the client during the coaching process, remains the intellectual property of the client. However, the client grants Coach2o a limited, non-exclusive license to use such materials for the purpose of delivering coaching services.
USE OF SHARED CONTENT: Clients and coaches often share information and documents during coaching sessions. Unless explicitly agreed otherwise, such shared content remains the intellectual property of the original owner. Clients and Coach2o agree to respect these ownership rights and ensure that any proprietary information is not disclosed or used beyond the scope of the coaching session without permission.
9. CONFIDENTIALITY:
Coach2o is committed to maintaining the highest level of confidentiality in all interactions with our clients. We understand the importance of privacy and the sensitive nature of the information shared during coaching sessions.
GENERAL CONFIDENTIALITY POLICY:
All information disclosed within coaching sessions, including personal data, business information, and session details, is treated as confidential and is not shared outside the coach-client relationship without the client’s expressed consent, except as required by applicable law or as detailed below.
MANDATORY DISCLOSURE:
RISK OF HARM: Notwithstanding the general confidentiality policy, there are circumstances where Coach2o is legally obligated to break confidentiality. If, during a session, the coach has reasonable grounds to believe that the client poses a risk of harm to themselves or others, the coach is required to report this information to the appropriate authorities to prevent harm. Such decisions are taken with the utmost seriousness and are guided by legal and ethical standards.
LEGAL REQUIREMENTS: In addition to scenarios involving potential harm, Coach2o may also be required by law to disclose certain information in response to subpoenas, court orders, or other legal processes. In such cases, only the minimum necessary information will be disclosed.
TRAINING AND SUPERVISION:
Confidential information may be discussed internally among Coach2o’s coaching staff for training and supervision purposes. However, all internal discussions are conducted with the same level of confidentiality and discretion that is extended to our external engagements.
CLIENT’S DUTY:
Clients are encouraged to maintain confidentiality regarding the content of their coaching sessions, particularly when it involves sharing insights or strategies that may involve third-party proprietary information.
CONSULTATION WITH LEGAL AUTHORITIES:
When disclosure is required, Coach2o will make every effort to discuss it with the client beforehand, except in circumstances where such discussion could increase the risk of harm.
By agreeing to these Terms and Conditions, clients acknowledge and consent to this confidentiality policy, including the specific circumstances under which confidentiality must be breached for safety or legal reasons.
10. DISCLAIMER OF WARRANTIES:
The coaching services are provided on an "as is" and "as available" basis. Coach2o LLC expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. LIMITATION OF LIABILITY:
In no event shall Coach2o or AWH Advising LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; or (iii) unauthorized access, use, or alteration of your transmissions or content.
12. INDEMNIFICATION:
You agree to defend, indemnify, and hold harmless AWH Advising LLC, DBA Caoch2o and its directors, officers, employees, and agents from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your breach of these Terms and Conditions, your misuse of the coaching services, or your violation of laws, regulations, or third party rights.
13. GOVERNING LAW AND JURISDICTION:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal actions or proceedings related to this agreement shall be exclusively subject to the jurisdiction of the courts of the State of Delaware.
